Delaware Death Penalty Struck Down

In a 3-2 decision, the Delaware Supreme Court has ruled the state’s death penalty unconstitutional. Chief Justice Leo Strine found that certain aspects of Delaware’s statute conflict with a recent U.S. Supreme Court Case striking down Florida’s capital punishment program.

    I think we should be on the lookout for a piece of fix it legislation in January (i.e., not allowing a judge to overrule a jury that decides against the death penalty). The decision leaves the door open, since the Supreme Court actually decided that the current death penalty law was unconstitutional, not the death penalty itself.

  6. Right. However, the State Senate passed death penalty repeal. Having said that, who knows if Karen Peterson’s successor and quite possibly Bryan Townsend’s successor will support death penalty repeal like they did? If they do, then the bill can’t pass.

    Of course, if John Carney lets the General Assembly know that he won’t sign such a bill, I doubt that leaders would want to put Carney in that position. Does anyone have any idea where Carney stands on this issue?
