Major Screw Up

Actually, as I read this NJ report there were a couple of interlocking screw ups in this DSU murder case.

The police fixed on a suspect based on the fact that there was an argument a few hours prior to the shooting and stopped investigating.

The prosecutor’s office screw up (not telling the defense about a possibly exculpatory eye witness for 14 17 months) is worse and something that even the prosecutor’s office can’t get its head around.

    Biden is toast from this. Even in Iraq.

    Imagine if this happened to you or someone you loved. Somebody should at least be disbarred.

    Beau is of course accountable… but I’m guessing the department wasn’t purged deeply enough when Beau took over. Two prosecutors with DUI since then, cases reassigned, AG out of town… sounds like chaos.

    I don’t want him as a senator. I didn’t want him as AG. I have nothing against him in particular, but I don’t like the Bidens. I consider them anything but progressive.

    Does that count as an agenda?

  8. If Biden is running against Castle, this will hurt him a lot. If he’s running against O’Donnell, not so much.

    I thought ‘they’ sent Geblien (sp) in as uber-A.G. After all, he’s been there, done that…..someone to help groom the next generation.

  11. Obviously, this has nothing to do with Biden as far as I can see. How he deals with this stuff when he comes back will matter more.

    I am just happy that an innocent man went free.

    I will celebrate that first, then I will join you in condemning the withholding of evidence and sloppy prosecution which created another victim to this crime.

    Look harder. He runs the office, and all this happened over 17 months — dating to when he was still theoretically running the office instead of running off to Iraq to beef up his wafer-thin resume.

    I find it amusing that, even when a Democrat actually has screwed up, you remain wrong. Quite a streak you’ve got going.

    If this was a Republican AG the wingnuts would be all over the empathetic judge letting a criminal go free on a technicality.

    I don’t think Biden literally had much to do with it, but so what, he’s still accountable. He can recover if he cleans house and puts in some new controls, and of course he can’t screw up again.

  15. Let’s not forget that GOPer Jane Brady (I draw disparaging conclusions based on what John Flaherty used to report about her) was Ruth Ann’s pick for a judicial post.

    Ostensibly that was to leave the AG spot open for Biden. She shuffled Danberg into the slot and then Biden took it in the general election.

    I have read anonymous WNJ postings that Jane Brady’s leftovers are clogging up the place. That’s not to say that any of that reflects on this blundered DSU campus murder case…OF WHICH NO ONE is yet proven innocent…. Dave.

    Under the aegis of Beau Biden are two cases that question his competency and focus to serve as our Attorney-general.The latest case is the dismissal of murder charges against Loyer Braden after the prosecuting attorneys were found to have withheld exculpatory evidence from the defense.The evidence was an eye-witness who would have excluded Mr.Braden as the “shooter”.The prosecutors may have ten witnesses willing to swear Braden WAS the shooter,but we,the citizenry,will never know.What kind of office is Biden running that allows this kind of stunt?

    The other case involves the killing of Derek Hale by Lt.Browne of the WilmingtonPoliceDepartment.Having to work with the WPD on a daily basis should have excluded the Attorney-general’s office from investigating this case in the first place.Beau didn’t care.His office investigated anyway.The resulting report is laughable and extremely biased in favor of the “shooter”.

    We all know Beau is doing his patriotic duty serving our country in Iraq.

    Beau should resign his commission and get back to Delaware and get his office in order or resign as Attorney-general and continue to serve his country.

    Our legal system does not find anyone innocent, ever. They are found not guilty. There’s a difference.

  18. This case didn’t even have enough evidence to go to trail. The evidence that was not presented was pretty exculpatory. It had video taped testimony of a witness saying that the person arrested was not even there. There was other evidence which pointed to his whereabouts being elsewhere.

    The physical evidence showed that he had not fired a weapon based upon lack of residue.

    “The witness said he was walking with Shalita Middleton and he saw the person that shot Shalita,” Liguori said. “He told the cop that it was not the guy they arrested — meaning my client. It was two guys with dreadlocks.

    The evidence for his guilt was circumstantial.

    The case was stronger for him not being guilty than guilty. There only needs to be reasonable doubt. This couldn’t get beyond suspicion. I am convinced that they had the wrong guy. This is not some technicality of the paper work not having the right county filled in.

  19. Geezer, I don’t understand the problem that you have with people in the service, but it is troubling. I am glad most Americans don’t share your Point of view.

    I agree that when AG Biden returns, he needs to get to the bottom of this fiasco. That is what it means to be responsible not some foolish notion of punishing people who did not commit the misdeed.

    I am sorry if I disappoint you by not attacking a Democrat reflexively. I am a person who wants the facts. I will withhold judgment over whether this is an AG systemic management issue or the actions of a couple of bad players until I have those facts.

    The police aren’t exactly covered in glory here either. Too bad there is a Biden available to deflect scrutiny from the cops… so I guess they go back to business as usual.
