I had Oberly as my Criminal Law prof while at Delaware.

Seemed like a personable, smart fella. He even had a end-of-semester BBQ for his students…

Bush could appoint someone if he wanted to be a prick. But I repeat myself.

Remember, this is the same President who kept trying to make recess appointments every time Harry Reid went to use the restroom.

That is most likely correct, anon. And while Bush could theoretically appoint someone, they still have to be confirmed by the Senate. So the Senate would nix the appointment until Obama was in office.

Delaware’s senior Senator makes recommendations for this position to the President, who makes the appointment.

I had to look this up… According to the News Journal, Connolly was appointed by Bush in 2001 based on a recommendation by Castle. I guess it goes to the senior office-holder of the President’s party?

Since Connolly is resigning on the 12th, I suppose Bush could theoretically appoint somebody.
