    Weird, since a woman recently apparently self-aborted, and now faces jail time b/c the fetus was viable.

    If she does time so should the guy who impregnated her.

    Then the point could be made that now, since abortion up to a certain point is legal in ALL cases, if the guy doesn’t want a baby but the woman does, why does he have to pay child support? If it’s only the WOMAN’S choice, then …??

    Jail time will depend on the state’s particular law, but while abortion is murder, I think we can still keep in mind the mitigating circumstances at let the charge be “voluntary manslaughter”.

    Here is how WIKI defines “Voluntary Manslaughter”

    “Voluntary manslaughter cases where the defendant may have an intent to cause death or serious injury, but the potential liability for the person is mitigated by the circumstances and state of mind.”

    I failed to add that if the biological father was an accessory in anyway he would be charged too. If the case is made that he applied physical or mental intimidation to force her into the abortion, then his charges would be upgraded to murder (probably 2nd degree) and her reduced or dropped depending on the level of pressure or intimidation applied.
